What a personalized plate actually is

How California, Texas, New York, and Virginia attach a chosen plate configuration to a registration, review the characters, renew the privilege, and handle a sale or a move.

The black MINI Cooper S carries RWDYBOY in gold on a black California plate. Does that word belong to the car?

No. A personalized plate is a configuration a state agrees to issue, then ties to a registration. Sell the car, trade it, or register it somewhere else, and the word stays where that state’s record leaves it.

Red-and-white vertical taillamps sit at the upper corners, with twin exhaust tips and a chrome strip on the lower bumper. The plate is a black California legacy plate with gold characters reading RWDYBOY and CALIFORNIA in small gold letters at the top, mounted low in a recess in the bumper. A white SUV is at the left edge, white sedans are parked at the right, and hedges and a building are behind.

RWDYBOY is gold characters on that black California plate, with CALIFORNIA in small gold letters at the top. The plate is mounted low in a recess in the bumper. California’s ordering page splits the metal into two kinds. An environmental plate is the standard plate, no graphic, and it is available only as a configuration the applicant chose. A special-interest plate carries a graphic. That one can be personalized, or it can be a sequential number. The environmental-plate page calls the environmental plate the original personalized plate, two to seven characters, for an automobile, a commercial vehicle, a motorcycle, or a trailer.

People still say vanity. The pages below say personalized. Texas assigns a general-issue number and says that number cannot be personalized. A chosen phrase is a specialty plate. You check whether the phrase is free at My Plates, the state’s marketing vendor, and the department approves it. New York calls its version a standard-series plate, made flat, with no embossed characters, carrying the combination you selected. You cannot order it before the vehicle is registered. Virginia’s ordering page adds a combination of up to seven characters to a plate that has room for them.

The state reads it, then it decides

California’s ordering page says the department may refuse a combination of letters, or of letters and numbers, that may be offensive to good taste and decency, that may be misleading, or that conflicts with a plate series already being issued. Swapping a number in for a letter, or a letter in for a number, is refused when the result can be confused with a plate that exists. The applications page is stricter on the lookalikes. The numeral zero is not used. The letter O is. The numeral 1 and the letter I do not stand in for each other, and Q does not stand in for O. The applicant has to explain what the configuration means. The refusal page names the readings that fail: a sexual connotation, a vulgar or profane term, a term of contempt or hostility, a racially or ethnically degrading term, a negative connotation aimed at a group, a configuration deleted from the regular series, a misrepresentation of a law-enforcement entity, a foreign or slang term, and a phonetic spelling or a mirror image of any of those.

Texas’s guidelines, dated January 13, 2023, put the review before the plates are manufactured. The department does not always take the applicant’s explanation as the meaning. It looks at how the pattern may be viewed, including slang, a phonetic spelling, a reverse spelling, and a mirror image. The sheet declines a pattern that collides with the regular numbering system, and a pattern that may be read as indecent, vulgar, or derogatory, as a reference to gangs, illegal activity, or violence, as a reference to a controlled substance, as a representation of law enforcement or another public office, or as something law enforcement could misread. The count depends on the design. Adding the access symbol shortens the pattern by two characters. Hyphens, periods, hearts, stars, and a silhouette of Texas are on the sheet. No two plates in the state may carry the same alphanumeric characters. An unavailable answer means the department pulled the pattern, or someone already has it. The vendor’s questions page puts a ceiling on its Select plates: up to eight letters, numbers, and special characters, with the design deciding how many actually fit. That page also says the department reviews the message after the purchase. A message the department treats as indecent, vulgar, derogatory, or a reference to illegal activity, among the other reasons on the guidelines, is declined, and the buyer can change it, appeal, or ask for a refund. The department’s plates page says the department does not refund a specialty plate, because the plate is manufactured for that order. A message that fails the review is not yet that plate.

New York’s combination page allows 2 to 8 characters on a standard plate, 2 to 6 on a motorcycle plate, and up to 6 on a picture plate. A space counts. A character is a letter, a number, the state image, or a space. Special characters are out. On a passenger or commercial plate the state image cannot be first or last, and it needs a character on each side. The department is not required to issue the request. The combination cannot look like an official plate. The page names NYS and POLICE as unacceptable. It cannot be obscene, derogatory, or offensive, a single letter, or six numbers followed by one letter. A zero standing in for an O, or a one standing in for an I, fails when the result reads as a word or a number. The restrictions page says no person has a right to a particular personalized plate. The commissioner issues it, or does not. The decision can come when the plate is requested, after it is approved and before it is made, or after it is on the car. A request that fails is treated as withdrawn. An issued plate that fails is invalidated. It comes off the vehicle, a standard plate goes on, and the registrant may pick another personalized plate that passes, or stay with the standard plate. The page says that choice does not add another charge. Another language, slang, an abbreviation, a phonetic spelling, and a mirror image all count as ways of reading it.

Virginia’s guidelines say the commissioner may reserve a combination, and that the department will deny one a person looking at the plate could reasonably read as profane, obscene, or vulgar, sexually explicit, excretory, a description of intimate body parts, an encouragement of violence, or a description of illegal activity or an illegal substance. The character count depends on the design. Letters, numbers, a dash, a space, and an ampersand are the characters the page allows, and the access symbol shortens what will fit. The ordering page’s seven characters is the public ceiling. The same guidelines say the department will cancel and recall a plate that was issued and later found out of compliance, including when ordinary language shifts and an old combination no longer passes. Bumper stickers, decals, magnets, and pictures on the vehicle can be part of that reading. Offering to take them off is not, on that page, a reason to reverse the recall. The department also will not issue a combination that can be read as a reference to children when an owner or co-owner is on the sex offender and crimes against minors registry.

Wide wraparound taillamps and a chrome strip run across the hatch, with two exhaust outlets at the bottom. The dark Lexus RX 350 carries a white Kentucky plate that reads MAWMAW, with Kentucky script and In God We Trust across the top, a blue band reading OLDHAM at the bottom, and a 07/24 sticker at the lower right. The file calls it a Kentucky plate. Kentucky is not one of the four reviews above. The word is still that state’s plate. Driving the RX into California, Texas, New York, or Virginia does not turn MAWMAW into a registration those states issued.

The car can leave. The configuration is its own record

California’s environmental-plate page says the plates remain with the owner when ownership of the vehicle transfers. The ordering page is the sale in practice. Most personalized and special-interest plates may stay on the car only if the plate owner releases priority. Without that release, the plates are surrendered, unless the transfer is between spouses, parents, children, or grandparents. The buyer who wants them files a new application. To keep them, take them off before the buyer takes the car. The buyer gets ordinary plates. Putting the same plates on another vehicle you own is a California reassignment, a separate transaction from the sale. Holding them off any vehicle is retention. The retention page says the owner may remove the plates and keep the configuration, without assigning them to another vehicle, if the retention charge is paid every year, whether or not a vehicle is assigned. Miss that charge, the ordering page says, and the plate is cancelled and the configuration may be given to someone else. A gift is entered in the recipient’s name. The applications page says the plate owner and the vehicle’s owner of record have to be the same person. The configuration is not a spare key that rides with the car.

Texas’s selling page lets the seller take the plates and the registration sticker. Transfer them to a vehicle of the same classification that you are buying. Keep them for a later transfer, in which case the sticker stays behind. Or deface the face of the plates so they cannot be reused. The plates page has you move plates onto another vehicle you own and pull the old sticker off the windshield. General-issue plates, on that page, transfer only to a passenger vehicle or a truck of one ton or less. The personalized plate is the specialty plate. The vendor’s questions page limits a transfer to another person to a My Plates Select plate won at auction. An ordinary message does not become the buyer’s because the screws were still in the trunk. The department’s questions page says that after a move out of Texas the plates are yours to keep, as a souvenir, and that recycling them means cutting them up so they are not used again. The vendor’s terms say the plates remain the property of the State of Texas, and that the right to possess them lasts for the period the plate fees cover. The department or the county can still reject the order after the vendor has processed it. A souvenir in a box is not a registration in the next state.

New York’s plates page says that if you get rid of the vehicle, or you are going to register it in another state, you turn the plates in. The surrender page says the same thing for a car being registered elsewhere. The New York plates go back to New York. A transfer onto another vehicle you own is a different errand. The personalized transfer page allows the move onto a vehicle you have purchased when the registrant and the registration class stay the same. A dealer is told to make that transfer. On a private sale, you ask the department to transfer the plates when you register the new vehicle. Replacing the plates, or changing the combination, goes through the Custom Plates Unit, and that page says the replacement or transfer cannot be done by mail or as a walk-up at an office. Storage is the path for a vehicle you take off the road. Most offices will hold personalized plates, and the office decides whether it will. The receipt is marked stored at that office, and the registration record shows the plates are stored. To put them on a vehicle again, you go back to the office that has them. That hold is for a car coming off the road. Registering the car in another state is the surrender on the plates page, and those plates go back to New York.

Virginia’s plate page requires the plates, and the registration, to be surrendered immediately if you sold the vehicle, traded it, stopped operating it, or moved out of Virginia. Deactivation is the other transaction. It keeps the plates when you need to cancel the liability insurance and you are not giving the plates up. The insurance stays in force until that deactivation is done. The department’s posted instructions, revised July 1, 2016, say a personalized message can be relinquished by the current owner and then purchased by another eligible person, and only with a signed statement from the owner who has it. The same instructions say the combination can remain available for up to 12 months after the registration expires.

The configuration has its own clock

California’s environmental-plate page puts an additional charge on renewal of the plate, on top of the registration. Retention is the yearly charge for a configuration that is sitting off a vehicle. Miss it and the configuration can be cancelled and reassigned. Pickup of a new personalized pair runs about 8 to 12 weeks after the order is processed, and the ordering page says you are told by mail when the plates are ready. If the registration expires within 30 days of that pickup, it has to be renewed before the plates can be assigned. If both personalized plates are lost or stolen, that same page says the configuration cannot be made again. You pick another one.

New York’s combination page collects the extra annual charge with the registration renewal. A renewal that runs two years includes two of those annual charges. The order is not part of the renewal, and it is not available before a registration exists. The registration you already hold cannot expire within 60 days. If it does, you renew, then you order. About ten days after the order is processed, a new registration document shows the current plate number and the new combination. The plates take longer. The page says to allow at least six weeks, and not to send the old plates back. Destroy them, so the old number is not used by someone else. Sending them in can cancel the wrong record.

Texas issues the specialty plate, random number or personalized, for a one-year, three-year, or five-year term. The annual registration renewal notice is where the plates page tells you the term is ending. If the selection is not renewed within 60 days of expiration, the system cancels it and anyone can order the message. The vendor’s questions page says that renewal runs through the department and the county tax office, with the registration, which is the moment to keep the message or order a different one. Virginia’s ordering page treats the personalization as a yearly charge in addition to the registration and any special-plate charge.

A cream-colored wood-sided wall covered in rows of license plates from many states, including California, Missouri, Washington, Maine, Tennessee, Connecticut, Arkansas, Idaho, Oregon, Texas, Georgia, Florida, Mississippi, Kansas, Iowa, Alabama, Illinois, Colorado, Minnesota, and Yukon, plus many yellow and white Alaska plates, some reading AK BOEN, 2KGRAD, and AK 2009. A white sign with red letters reads FOR SALE INSIDE. Antlers are mounted along the top, an electric meter and conduit run down the middle, and a teal-framed window is at the left edge.

The file places this wall at a craft market in Fairbanks. The sign reads FOR SALE INSIDE, in red letters on white. Texas’s souvenir section says a souvenir plate is not street legal and is not an insignia of registration. The metal can be a gift or a decoration. It does not register a car.

A title is the ownership record. These plate pages leave it alone. New York says no person has a right to a particular personalized plate. California’s priority is a plate-owner’s claim inside California’s file. It can be released, retained, or reassigned. Texas’s right to possess the plates runs with the fees, and the plates stay the state’s property. A historic plate is a different registration. California’s historical plates stay on that vehicle. A personalized configuration is the owner’s approved combination, on the vehicle the registration currently names.

The plate is the registration number the state agreed to issue, for as long as that registration and that plate privilege are kept up. It does not establish what the owner meant. Texas reviews the pattern as it may be read. It does not establish a registration in the next state. New York and Virginia want the plates back when the car is registered elsewhere. Texas will let you keep the metal, and it will cancel the selection if you do not renew it. It does not establish that a buyer owns the word because the screws were still in the bumper.

Check the state that issued the plates, the name on the plate record, and whether the configuration is assigned, retained, stored, or surrendered, before you assume the word is coming with the car.
